otice of Travel Risks and Related Matters

This company, based on the Contract Law of the People's Republic of China, the Tourism Law of the People's Republic of China, and the Tort Liability Law of the People's Republic of China, as well as Article 1176, Paragraph 1 of the Civil Code of the People's Republic of China, which states the principle of "voluntary assumption of risk," and drawing from practical experience in outdoor travel, has drafted this Travel Risk Notice (hereinafter referred to as the Notice). The purpose is to inform participants of the risks they need to guard against during their trip, their obligations to take preventive measures and make preparations, and other relevant agreements.

I. Confirmation of Terms of Service

If you wish to participate in the event organized by Slow Travelers Outdoor Club (hereinafter referred to as "this club"), please be sure to read the Outdoor Travel Risk and Related Matters Notice (hereinafter referred to as "this notice") and indicate your agreement to accept this notice during the registration process. Once you confirm your registration or payment, it means you voluntarily accept all the terms of this notice.

2. Precautions

1. Scope of activities

This event is for enthusiasts to participate voluntarily, share responsibilities, and bear risks themselves; the organizer (including the leader) is also a voluntary participant and does not have absolute management or control over other participants; for any sudden uncontrollable factors that may affect everyone's safety and interests, all participants must reach a consensus; the initiator or leader has only the obligation to organize and coordinate the entire team, while participants are also obligated to comply with the overall arrangements of the event.

Outdoor sports are different from regular tourism activities. The routes adopted are unconventional tourism routes, which have certain adventure nature and risk.

Participants can engage in activities organized by the Slow Travelers Outdoor Club during the agreed period, including but not limited to leisure travel, hiking, mountaineering, mountain crossing, camping, fixed-route cave exploration, wilderness survival; orienteering, team-building activities, and fun on-site activities; cycling, mountain bike off-road, self-driving tours; swimming, diving (diving depth not exceeding 18 meters), stream tracing, boating, kayaking, rafting; rock climbing and rappelling in artificial or natural venues, ice climbing, skiing; horseback riding. If participants violate the arrangements made by the organizers (or leaders and other relevant staff) and independently conduct other non-club-organized activities, all risks and responsibilities arising therefrom shall be borne by the participants themselves, and have nothing to do with the organizers.

2. Physical condition

Participants should ensure their personal health when attending activities and must not have any physical conditions that make them unsuitable for the activities listed in this Notice. The physical conditions that make one unsuitable for participating in these activities include, but are not limited to: (1) patients with infectious diseases such as hepatitis, active pulmonary tuberculosis, typhoid fever, etc.; (2) patients with cardiovascular diseases such as severe hypertension, heart failure, myocardial hypoxia, myocardial infarction, etc.; (3) patients with cerebrovascular diseases such as cerebral embolism, cerebral hemorrhage, brain tumors, etc.; (4) patients with respiratory diseases such as emphysema, cor pulmonale, etc.; (5) patients with mental disorders such as epilepsy and various types of psychiatric patients; (6) patients with severe anemia; (7) patients recovering from major or medium surgeries; (8) pregnant women and those with mobility issues; (9) other physical conditions that prevent them from meeting the requirements of this trip. Organizers do not recommend participants with the above conditions to join the activity. If they insist on participating, they must obtain written consent from a doctor in advance, prepare necessary medications, and obtain the agreement of immediate family members such as parents or children, accompanied by a designated person. Additionally, they must sign a commitment document with the club, stating that they do not have any physical conditions that would make them unsuitable for the activity within the agreed period, or that although they do have such conditions, they can ensure that they will not suffer any physical or financial loss during the activity due to these conditions. In case of accidents caused by personal reasons, the participant must bear full responsibility. In addition, given the varying operational costs and individual circumstances, the event organizers are not responsible for determining whether participants' physical conditions are suitable for the activities before they begin, nor do they charge any related fees. The responsibility and associated risks are borne by the participants themselves. If a participant conceals their physical condition that makes them unsuitable for the activity or fails to manage their health in a reasonable manner (such as not taking medication on time), any loss of health or property due to their physical condition during the trip shall be borne by the participant themselves.

The organizers and leaders of the event are not doctors or emergency personnel with professional medical licenses; they often lack the medical skills required for first aid or healthcare. Participants should pay attention to their own safety and prepare common medications and first-aid supplies according to their needs. If any discomfort occurs during outdoor activities, please inform the leader or relevant staff promptly so that medical assistance can be arranged in a timely manner.

3. Various risks that may be faced by participating in outdoor travel

Participants, as individuals with full civil capacity (minors are not allowed to participate in outdoor activities organized by this club alone), should be aware of the various risks associated with outdoor activities and fulfill their reasonable duty of care and prevention. These risks include, but are not limited to, dangers from transportation, geological factors such as earthquakes, floods, and landslides, natural hazards like falls, falling rocks, ice avalanches, snow avalanches, lightning, and epidemics or diseases, and risks posed by third parties, individuals, or animals, such as drowning, crossing rivers, hypothermia, frostbite, injuries from bites, stings, dog attacks, and wild animal assaults. Such risks may lead to injuries, fractures, disabilities, or even threats to life safety. The above description is incomplete, and there may be other unforeseen risks. These risks can result in personal injury, property damage, or harm to the person or property of third parties.

In addition, outdoor activities place severe demands on both physical and mental health, including activities in rugged terrain and harsh weather conditions. These often involve being far from rescue and medical services, with lengthy wait times for assistance. As a result, failing to receive timely medical care can lead to more serious consequences or even life-threatening situations. Even if the team leader and other club staff have fulfilled their reasonable duty to care and provide assistance, and have taken appropriate rescue measures, if the loss of physical or property interests cannot be recovered, the adverse consequences will still be borne by the participants themselves.

4. Description of other risks

First, outdoor travel activities inherently carry an element of unpredictability, which is part of their allure. Participants should be aware that organizers and guides cannot possibly foresee every potential risk during outdoor trips (of course, the relevant staff members of our club have extensive experience and can anticipate and warn against most risks associated with outdoor activities). Participants should also accept the fact that unforeseen risks may arise during outdoor trips and bear the responsibility for these risks. Additionally, participants must understand that physical activity and the use of equipment can pose potential hazards. They should also recognize that fitness and recreational activities carry the risk of injury or even death, and voluntarily participate in these activities and use the equipment provided.

Secondly, during the self-arranged activities, participants should choose activity items within the scope of their ability to control risks and report them to relevant staff in time, actively ask about the risks of related activities and matters needing attention, abide by the safety warning regulations in tourism activities, and take responsibility for their own safety.

Again, participants can reduce risks through the following measures: pay more attention to the environment, monitor physical and mental conditions, ensure that all safety-related clothing and equipment is suitable, and only participate in activities within their physical and mental capabilities. Encourage a questioning and skeptical mindset, asking organizers and leaders for explanations of any decisions deemed inappropriate by individuals. If a participant firmly believes that continuing an outdoor activity is unsafe, they should immediately stop the activity but must inform relevant staff and complete necessary procedures.

Finally, when a companion needs assistance, the participant can offer help within their capabilities and without posing unreasonable risks to themselves. If the situation exceeds one's or others' abilities, or if it poses potential danger to oneself or others, the participant has no legal obligation to assist. Similarly, no companion or other member is legally obligated to assist in such situations. Of course, during the process of providing assistance, reasonable care must be exercised to avoid causing secondary harm to the victim.

Other relevant agreements for travel

1. Participants must truthfully report their personal information when signing up for outdoor activities and carefully verify that the reported information is accurate. It is strictly prohibited to participate in activities under false identities or by impersonating others. If discrepancies arise between the identity information provided during registration and the actual identity of the participant, leading to issues such as failing customs clearance, being unable to board an aircraft or other modes of transportation, or insurance claims being denied, all resulting adverse consequences will be borne by the participant. Furthermore, if any staff member discovers that an individual has provided false information, the club reserves the right to disqualify them from participating in the activity and refund the corresponding amount according to the refund policy published by the club.

2. Do not leave the group without authorization or leave the group alone when traveling in a group. If you want to leave the group, you must obtain written consent (departure agreement) from the tour leader or the staff accompanying the group.

3. Agree that the organizer of the activity and other teammates will use the pictures of the participants for future online, magazine and other publicity activities or share them on their circle of friends free of charge.

4. In order to ensure the quality and safety of the activity, the slow travel bus should not be overloaded. Please fasten your seat belt after boarding the bus.

5. Insurance: Participants must fully understand the uncertainties and risks associated with outdoor activities, be aware of the necessity to purchase insurance before participating, and have the ability to bear the cost of the insurance. They should voluntarily buy insurance before the event to reduce the risk of injuries or direct losses incurred during the activity. In the event of personal injury or property damage during the activity, all losses will be covered by the insurance company within its liability limits. The organizer (including the team leader) and other participants will not bear any expenses or legal liabilities arising from the incident.

The club offers the following insurance policies: Outdoor Accident Insurance, which covers from boarding the vehicle to the end of the activity and upon returning to the vehicle (for those who disembark during the return journey, the insurance ends upon disembarking); Domestic Long-Distance Activity Insurance, which covers from the day of assembly to the day of the activity's conclusion. Apart from the insurance explicitly purchased by the club for participants, all other insurances must be purchased independently by the participants. Participants can seek advice on purchasing insurance from relevant staff members of the club, but the club does not generally act as an agent for purchasing such insurance. It is recommended that participants purchase additional supplementary insurance to guard against any accidental injuries.

6. Minors under the age of 18 are not allowed to register for activities alone; those under 18 must be accompanied by a guardian. The safety of minors who are not fully capable of civil acts during outdoor activities is guaranteed by the accompanying guardian. Any adverse consequences resulting from their actions or suffering, which are not due to the responsibility of relevant staff, shall be borne by the minor and the guardian. During the trip or free time, guardians are required to supervise and protect their children at all times, ensuring that minors do not act alone and paying attention to their safety.

7. Given that many people participate in outdoor activities through proxy registration, the club is unable to directly fulfill its duty of informing the actual participants. Therefore, those who register on behalf of others have the obligation to promptly and comprehensively inform the actual participants of all relevant information (including but not limited to explanations of the terms of this notice, special reminders and warnings for participants, and provisions in the contract regarding the club's liability exemptions). They must also inform the club of the relevant information of the actual participants (including but not limited to health information, information about unsuitable travel activities, etc.).

Iv. Attribution of corresponding responsibilities and solutions

1. If the participant fails to act in accordance with the provisions of this Notice, the instructions of relevant staff and the provisions of laws and regulations during the outdoor outing organized by the Club, resulting in loss of his/her body or property interests, the participant shall bear the corresponding responsibility by himself/herself.

2. Since outdoor activities inherently carry certain risks, participants should be aware of these risks before participating. Therefore, if, during the activity, relevant staff have fulfilled their reasonable duty of care and taken appropriate measures, but still unavoidable natural disasters or other force majeure events or accidents result in physical or property damage to the participant, such losses shall be borne by the participant.

3. Participants should follow the instructions of the leader and other relevant staff during outdoor travel activities, and shall not engage in any acts that violate laws and regulations. If any loss of property or physical interests of a third party is caused by personal behavior during this activity, the participant shall be responsible for it and has nothing to do with the Club.

4. If the participants suffer losses and dangers that should have been avoided due to the illegal operation or improper introduction of the team leader and other relevant staff of the Club, the participants may negotiate with the Club for settlement. If no agreement can be reached through negotiation, they may file a lawsuit to the court with jurisdiction.

5. There is no personal attachment between the organizer and participants of outdoor travel activities. If the participants cause loss of body or property interests to each other due to human factors such as conflicts rather than the responsibility of relevant staff, the parties concerned shall settle the matter through negotiation without the club's involvement.

The content that participants must be aware of in addition to what is explicitly stated in this notice includes announcements on the webpage, verbal tips from the tour leader, and other relevant information conveyed by the organizers through various means. Therefore, please read this notice carefully and actively prepare for risk prevention and travel conditions according to its corresponding content. Any other details not covered in this notice shall be subject to information communicated by our company in other forms.

If the participant is willing to participate in the outdoor travel activities organized by the Club on the premise of agreeing to the relevant contents of this notification, please sign the Outdoor Travel Responsibility Commitment Letter.
